1. Acceptance of Terms

By accessing and using the MKVID platform at mkvid.com ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Age Restrictions

You must be at least 18 years of age to use MKVID. By using this Service, you warrant that you are at least 18 years old and legally capable of entering into binding contracts.

3. Description of Service

MKVID is an AI-powered video distribution and metadata generation tool. It allows users to schedule, optimize, and publish multimedia content to third-party platforms including TikTok and YouTube through their official APIs.

4. User Responsibilities and Content

You are solely responsible for all content you publish using MKVID. You agree not to use the Service to post content that:

  • Violates the terms of service of the target platform (including the TikTok Terms of Service and YouTube Terms of Service).
  • Infringes upon the intellectual property, copyright, or trademark rights of others.
  • Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Contains misleading or deceptive commercial content without proper disclosure.

5. Publishing Consent and User Authorization

MKVID publishes content to third-party platforms only when you explicitly initiate the action. Specifically:

  • Explicit Action Required: Content is posted to TikTok or YouTube only when you click "Publish to TikTok" or "Save as Draft". MKVID never publishes content automatically or without your direct command.
  • Pre-Publish Review: Before publishing, you are presented with all posting parameters (privacy level, interaction settings, commercial disclosure) and must actively confirm your selections.
  • Privacy Level Selection: You must explicitly select a privacy level for each post. No default privacy level is pre-selected.
  • Commercial Content Disclosure: If your content is commercial in nature, you are responsible for enabling the commercial content disclosure and selecting the appropriate category ("Your Brand" or "Branded Content") as required by TikTok's policies.
  • Music Usage: By posting content through MKVID, you acknowledge and agree to TikTok's Music Usage Confirmation.

6. TikTok API Usage and Compliance

MKVID integrates with TikTok via the official TikTok Content Posting API. By using MKVID to connect your TikTok account, you acknowledge and agree to the following:

  • You are granting MKVID access to the OAuth scopes user.info.basic, video.publish, and video.upload as displayed on the authorization screen.
  • You are bound by the TikTok Terms of Service for all content published via MKVID.
  • You may revoke MKVID's access to your TikTok account at any time through TikTok Settings > Security > Manage App Permissions.
  • MKVID respects all creator-level restrictions on Duet, Stitch, and Comment settings as enforced by TikTok's API.

7. YouTube API Usage and Google Terms

By using MKVID to publish to YouTube, you are agreeing to be bound by the YouTube Terms of Service. We strongly advise you to review:

MKVID relies on third-party APIs to deliver its core functionality. We are not responsible for service interruptions, changes, rate limits, or access revocations imposed by TikTok, YouTube/Google, or any other third-party platform.

9. Account Termination

We reserve the right to suspend or terminate your MKVID account if you violate these Terms, abuse the platform APIs, or engage in activities that may cause harm to MKVID or its users. You may also delete your account at any time by contacting [email protected].

10. Disclaimer of Warranties

The Service is provided "as is" and on an "as available" basis. MKVID makes no warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

In no event shall MKVID or its operators be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, revenue, or business opportunities.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
